Abstract: The judgments of the plagiarism of work of fine art lack the effective support from the 

theory and methods, which influences the development of fine art innovation and the development 

of the works of fine art market. “The test of total concept and feel” may provide a solution but it 

still requires further clarity of the ideas and expression of the works of fine art. Fine art appreciation

 theory provides an appropriate means for that. The configuration of fine art includes content and 

form that correspond to the ideas and expression. The elements of expression that should be 

considered within the scope of copyright protection include organizational structure, the visual 

vocabulary and the abstract vocabulary, but in the meantime we should not do the overall analysis 

by ignoring the rest parts. Both the comparison of elements and the overall feel are indispensable.
