Abstract: The retained land resettlement is a means of land compensation in practice, it is a 

bottom-up institutional innovation and conducive to the landless peasants to share the land 

value added benefits of urban development, and it is helpful to solve the landless peasants ’

longterm livelihood to an extent. But the retained land resettlement dues to lacking legal support, 

there are still a series of problems to be solved urgently in practice. Though the right in regard to the

right of using retained lands conducive to better achieve land property rights and ensure their 

longterm livelihood, and there is of great benefit in constructing the legal system of land rights in 

our country.
