Overview
Department of law SCUT originated from Canton Institute of Law and Politic in 1905. SCUT rebuilt department of law in 1993; recruited undergraduates since 1995, students with dual degree in 1999 and graduates in 2002. In order to be a comprehensive university, SCUT established the School of Law in 2004. In January 2006, under the authorization of Degree Committee of the States Council, the School of Law formally turned into an authorized place for the first class discipline for Master’s Degree. Now the School of Law has six authorized places for the second class discipline for Master’s Degree: Legal Theory, Legal History, Criminal Law, Economic Law, Civil and Commercial Law and Procedural Law. In April 2007, under the approval of Degree Committee of the States Council, SCUT became a unit training professional Jurist Masters. Since 2008, LL.M (non-law undergraduates) and Jurist Masters who had held a post could be recruited. Since 2010, LL.M (law undergraduates) and Masters of Civil and Commercial Law (especially on intellectual property rights) could be recruited. In March 2011, under the authorization of Degree Committee of the States Council, the School of Law formally turned into an authorized base for the first class discipline for Doctor’s Degree.
Introductions of Specialties
Legal Theory
The Legal Theory settles varieties of searching directions such as Jurisprudence, Legal Methods, Legal Society, Comparative Law and Legal Culture and so on. Students are encouraged to study general theories of law by knowledge from many other subjects includes Philosophy, Society, Economy, Hermeneutics, History an so on; implement general theories of law to study all kinds of legal problems during Chinese legal practices and researches of doctrinal laws.
The leader of the Legal Theory academic team is Prof. Hongyi Ge, the vice president of Chinese Jurisprudential Research Team, the former president of the institute of law in Northwest University of Political Science and Law, the Ph.D supervisor of Legal Theory in CUPL, who has established more than 10 sets of national teaching methods, more than 10 sets of essays and more than 90 thesis in national key journals, and held or participated in many national or provincial social science fund projects.
The Legal Theory of SCUT has become a major Legal Theory researching base in southern China or even in nation.
Legal History
The Legal History settles 3 searching directions such as Chinese Legal History, Foreign Legal History and Comparative LegalCulture. Students are acquired to have a solid and extensive theoretical foundation and faculty and a deep professional knowledge. They would become overall-developed professional talents who could do research, teaching and legal practice ofLegal History alone by learning essence of legal history and experiences of legal history at home or aboard.
Tutors of Legal History, Prof. Honglin Zhang and vice Prof. Jianxing Ma, holding a stableprofessional foundation and a rich teaching experience, have established sets of prestigious academic monograph and dozens of academic essays in crucial journals, shaped their own teaching characteristics, and held or participated in many provincial research projects, among which gained first prize of Cantonese Educational Research Program.
Criminal Law
Criminal Law is one of the earliest area that recruit graduates. 2 professors built up a graduates’ guidance team, under which 3 searching directions are settled such as Chinese Criminal Law, Criminology and Criminal Policy. Prof. Songlin Xu, director of Chinese Criminal Law Institute, vice president of Cantonese Criminal Law Institute, vice president of CantoneseProcuratorial Institute, vice president of Cantonese Teenagers’ Criminal Institute, has a significant comprehension on Criminal Law and Criminology; Prof. Xuexiang Hu, vice president of Cantonese Criminal Institute, executive director of Cantonese Teenagers’ Criminal Institute, vice president of Guangzhou Teenagers’ Criminal Institute, legislative consultant of Guangzhou, has a professional advantage of sentencing theory and criminal policy.
The guidance team of Criminal Law has a powerful strength, a a rich teaching experience, an appropriate aged connstruction and sets of researching programs. It has established sets of prestigious academic monographs and dozens of academic essays on crucial journals, shaped their own teaching characteristics, and held or participated in many national or provincial research projects, which gained many prizes. Also, it gained first prize of Cantonese Educational Research Program.
SCUT’s curriculum Criminal Law became national essence curriculum and Cantonese essence curriculum in 2007.
Economic Law
SCUT granted the Master’s degree of Economic Law and recruited the first bachelors of Economic Law in 2003. 3 searching directions are settled such as Comparative Study of Foreign Economic Law, Insurance and Financial Law and Taxation Law.
The leader of Economic Law is Prof. Fuqiang Zhang, who is the vice president of Chinese Taxation Law Educational Institute and executive director of Cantonese Tax Law Institute. And Prof. Jianwen Liu, president of International Tax Law Institute, president of Chinese Taxation Law Educational Institute, executive director of Chinese Economic Law Institute, executive vice president of Chinese Taxation Law Institute, chairman of Taxation Law Institute of Peking University, is invited to be our part-time professor. He has held sub-projects ofNational Philosophy and SocialScience Foundation, key projects of Cantonese Philosophy and SocialScience Foundation, major projects of Philosophy and SocialScience Foundation ofGuangzhou and other numbers ofresearch projectscommissioned byenterprises; shouldered the responsibilities of Legislative Counsel of Cantonese Municipal People's Congress and LegalAdvisorof Cantonese Municipal CPPCC; participated in work on drafting of laws and regulations for National People's Congress and Cantonese People's Congress; published more than 100 academic essays in key journals at home and abroad, and more than 10 academic monographs.
Civil and Commercial Law
Civil and Commercial Law area recruits graduates in directions of either The Basic System ofCivil and Commercial Law or Intellectual Property Legal System. The Basic System ofCivil and Commercial Law mainly studies a set of basic theory, basic system and basic legislation ofCivil and Commercial Law meanwhile Intellectual Property Legal System mainly studies basic theories of intellectual property, intellectual property legal system, protection of Internet intellectual property, judicial protectionof intellectual property, international protection and so on.
The teaching team of Civil and Commercial Law is consisting with 2 PROFESSORS AND 4 ASSOCIATE PROFESSORS. They have established prestigious academic essays at home and abroad, and published teaching books and monographs such as Civil Law, Intellectual Property Law, Commercial Law, Content Law, E-Commercial Law, Real Estate Law and so on. At the same time, they have held and participated in many study programs about civil and commercial law and intellectual property law.
Civil and Commercial Law is in order to train highly-level legal talents who are able to hold both ability and integrity, master legal theoretical basics and extensive foreign trade knowledge,possess excellent skills of foreign language, adapt to the demand of developing economy and society and be competent to basic theories of Civil and Commercial Law and intellectual property legal system by setting curriculums on Civil and Commercial Law and intellectual property rights.
Procedural Law
Procedural Law settles 2 directions which are Civil Procedural Law and Criminal Procedural Law to separately study judicial organs’ procedure and judicial practice. Procedural Law has the closest connection to judicial practice. Talents from Procedural Law are the hot demand to judicial departments because they have a solid theoretical foundation and an advantage in working skills and efficiencies. The aim of Procedural Law is to shape highly-level professional talents who could have a solid and extensive theoretical foundation, a systematical and deep professional knowledge, a social legal development-adaptable ability and a capability in legal research and legal practice.
The teaching team ofProcedural Law is consisting with 2 PROFESSORS AND 2 ASSOCIATE PROFESSORS. They hold a stable professional foundation and a rich teaching experience, have established sets of prestigious academic monographS and dozens of academic essays in crucial journals, shaped their own teaching characteristics, and held or participated in many national or provincial research projects, which gained many prizes. Graduates are acquired to have a solid legal theoretical foundation, an overall knowledge of doctrinal law and a basic knowledge of society. They should master at least a foreign language and be able to read professional foreign materials, should have appropriate theoretical knowledge and the ability of abstract thinking, and should have the capability to do legal theoretical research, legal theoretical teaching, national legislation, judicial work and other related legal practice alone.
Full-time Jurist Masters
Master’s Degree of Laws is a professional degree with a specific context of legal profession. The aim of the degree is to shape high-level, composite, application-oriented legal expertise that can be competent in real departments and can adapt to socialist market economyand socialistlegal system. Graduates are acquired to have a sound political quality and legal belief to obey and protect the constitution and laws and adhere to legal ethics, master a solidlegal basic theory andbroadenknowledge oflegal practice, possess a required knowledge structure,characteristicsand applicationof thinking from legal standings, hold the ability to engaged inlegal practice, legal managementand legal application alone by using legal, economic, computeror other related professional knowledge, reach correspondingofficerequirements ofabove the intermediate level(including intermediate) professional positions from related departments,master at least a foreign language and be able to read professional foreign materials and have a sound physical and mental health to be competent in legal professional jobs.
Maters that School of Law shaped would have a proper theoretical knowledgeandresearch capacity, and a rich practical experienceandpractical skills. They could use theories to analyze and solve real legal problems. Now the School of Law has 739 undergraduates, 128 full-time Masters of Law, 157 full-time Jurist Masters and 152 in-service Jurist Masters. Most graduates would choose to go to Government departments,public securityagencies, largestate-owned enterprises, well-known law firms, foreign enterprises and so on. They have favorableemployment prospects.
